1. Introduction

Welcome to StacPay.

The following Terms of Service ("Terms") govern your access to and use of the StacPay website, mobile application, and related services (collectively, the "Platform"), operated by StacPay Technologies Limited ("StacPay," "we," "us," or "our"). By accessing or using the Platform, you agree to comply with these Terms, our Privacy Policy, and any other policies referenced herein. If you do not agree with these Terms, do not use our Platform.

These Terms apply to all users of StacPay, including but not limited to:

Customers: Users who purchase goods or services through StacPay.
Merchants: Users who sell goods or services on StacPay.

2. Key Definitions

Services: The payment processing and related services provided by StacPay.
Platform: The StacPay website, mobile application, and any associated systems.
Account: A registered user profile on StacPay.
Transaction: Any payment, purchase, or sale conducted through StacPay.

3. Account Registration and User Obligations

Users must be at least 18 years old to register an account on StacPay.
You agree to provide accurate, complete, and up-to-date information during registration and to keep your account credentials secure.
You are responsible for all activity occurring under your account. StacPay is not liable for unauthorized access due to your negligence.

4. Transactions and Payments

Merchants must clearly describe their products or services before listing them on the Platform.
Customers agree to make full payment for any purchase initiated through the Platform.
StacPay facilitates transactions but does not own or sell any products/services listed by Merchants.
Fees and payment terms are outlined in our Payment Terms policy.

5. Cancellations, Refunds, and Dispute Resolution

Merchants must fulfill all paid orders and must not cancel services without just cause.
Customers may request refunds according to the Merchant's stated refund policy and applicable laws.
Disputes between Customers and Merchants should be resolved amicably. If a resolution cannot be reached, StacPay may intervene in accordance with our Dispute Resolution Policy.

6. Prohibited Activities

Users agree not to:

Engage in fraudulent, deceptive, or unlawful activities.
Use the Platform for money laundering or any illicit financial activities.
Misuse or exploit minors by exposing them to inappropriate content.
Post false, misleading, or defamatory content.
Attempt to disrupt StacPay's services through hacking, malware, or other malicious actions.

7. Data Protection and Privacy

Your personal information is processed in accordance with our Privacy Policy. By using the Platform, you consent to StacPay's collection and processing of your data.

8. Intellectual Property

StacPay owns all rights, titles, and interests in its trademarks, logos, and Platform content.
You may not use, copy, modify, or distribute StacPay's intellectual property without prior written permission.

9. Limitation of Liability

To the maximum extent permitted by law, StacPay is not liable for:

Any losses resulting from the use or inability to use our Platform.
Transactions or disputes between Customers and Merchants.
Unauthorized access to user accounts due to negligence.

10. Termination and Suspension

We reserve the right to suspend or terminate your account if you violate these Terms. StacPay may also suspend services for maintenance, legal compliance, or security reasons.

11. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Nigeria. Any disputes arising from these Terms shall be resolved through arbitration or litigation in Nigeria.

12. Amendments and Updates

StacPay reserves the right to modify these Terms at any time. Users will be notified of significant changes. Continued use of the Platform constitutes acceptance of the revised Terms.
